A record 10 states had abortion-related ballots in the 2024 election. While Florida was the first to register a disappointing result, failing to receive a supermajority of votes to pass the Initiative for the right to abortionseven states passed abortion rights amendmentsincluding Missouriwhere abortion was completely outlawed after his overthrow Roe v. Wade.

How states voted on abortion rights amendments

Arizona vote yes Prop. 139, or Abortion Rights Initiative. The ballot measure protects the right to an abortion up to the viability of the fetus or about 24 weeks and if the life of the pregnant woman is in danger.

Colorado has voted in favour approves amendment 79or the Abortion Rights and Health Insurance Initiative. Abortion is legal in the state and the ballot recognizes the right to abortion in the constitution and allows public funding to be used to cover abortions. The measure needed 55% of the vote to pass and received 61.5%.

Florida it failed to receive a supermajority of votes to pass Amendment 4or the Abortion Right Initiative. The ballot would protect abortion rights until viability, or about 24 weeks, and if the pregnant woman’s life was threatened after viability. While the amendment received the majority of the vote at 57%needed 60% of the vote to pass.

Maryland voted in favor of Question 1 or of Reproductive Freedom Amendment. The ballot measure guarantees the right to reproductive freedom and protects the “ability to make and carry out decisions to prevent, continue or terminate” a pregnancy.

Missouri has voted in favor of amendment 3or Reproductive Freedom Amendment. Missouri had a complete state abortion ban after it was overturned Roe v. Wadeand the ballot measure now repeals that ban and protects the right to an abortion up until fetal viability, or about 24 weeks, with exceptions beyond.

Montana vote yes Constitutional Initiative 128or the Abortion Right Initiative. The ballot protects the right to abortion until the fetus is viable and if the life of the pregnant woman is in danger.

Nebraska has voted against Initiative 439 or the Abortion Rights Initiative. The ballot protects the right to an abortion until the fetus is viable or if the life of the pregnant woman is in danger. Initiative 434, which amends the state constitution to ban second- and third-trimester abortions (except for rape, incest, or medical emergencies), passed.

Nevada voted for question 6 or her Initiative for the right to abortion. The ballot protects the right to abortion until the fetus is viable and if the life of the pregnant woman is in danger. Voters would have to approve it in two consecutive general elections, so it would be on ballot again in 2026.

New Yorkers they voted for Prop. 1 to enshrine access to abortions in the state constitution. Abortion is legal in the state, but the initiative, known as the Equal Rights Amendment, adds language banning discrimination against individuals based on “pregnancy, the results of pregnancy, and reproductive health care and autonomy.”

South Dakota voted against Constitutional Amendment G, or the Abortion Rights Initiative. The state currently has a complete ban on abortion (except to save the life of the pregnant woman), and the ballot measure would have enshrined the right to abortion in the state constitution until the second trimester, or about 13 weeks, and if the life of the pregnant woman is at risk.
